I. Acceptance of terms
By using Bistrapay, you agree to be bound by these terms and conditions. If you do not agree to these terms, do not use Bistrapay.
II. Modification of terms
Bistrapay reserves the right to modify these terms at any time. Any modifications will be effective immediately upon posting on the Bistrapay website or app. Your continued use of Bistrapay after any modification indicates your acceptance of the modified terms.
III. Use of Bistrapay
Bistrapay is intended for personal use only. You may not use Bistrapay for any illegal or unauthorized purpose.
IV. Account registration
In order to use certain features of Bistrapay, you must register for an account. You agree to provide accurate and complete information when registering for an account, and to update your account information as necessary. You are responsible for maintaining the confidentiality of your account and password, and for all activities that occur under your account. Bistrapay will not be liable for any loss or damage arising from your failure to comply with this requirement.
V. Fees
Bistrapay may charge fees for the use of Bistrapay. Bistrapay may change its fees at any time. Bistrapay will notify you of any fee changes by posting the changes on the Bistrapay website or app. Your continued use of Bistrapay after any fee change indicates your acceptance of the modified fees.
VI. Refunds
Bistrapay does not offer refunds for any reason.
VII. Limitation of liability
Bistrapay will not be liable for any indirect, incidental, special, consequential or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, good-will, or other intangible losses, resulting from (i) your access to or use of or inability to access or use Bistrapay; (ii) any conduct or content of any third party on Bistrapay, including without limitation, any defamatory, offensive or illegal conduct of other users or third parties; (iii) any content obtained from Bistrapay; or (iv) unauthorized access, use or alteration of your transmissions or content, whether based on warranty, contract, tort (including negligence) or any other legal theory, whether or not Bistrapay has been informed of the possibility of such damage, and even if a remedy set forth herein is found to have failed of its essential purpose.
VIII. Indemnification
You agree to indemnify and hold Bistrapay and its subsidiaries, affiliates, officers, agents, co-branders or other partners, and employees, harmless from any claim or demand, including reasonable attorneys' fees, made by any third party due to or arising out of your breach of these terms or the documents they incorporate by reference, or your violation of any law or the rights of a third party.
IX. Termination
Bistrapay may terminate your access to Bistrapay, without cause or notice, which may result in the forfeiture and destruction of all information associated with your account. All provisions of these terms which by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity and limitations of liability.
X. Intellectual property
Bistrapay and all content and materials included on the app, such as text, graphics, logos, images, and software, are the property of Bistrapay or its licensors and are protected by copyright and trademark laws. You may not use any content or materials on Bistrapay for any commercial purpose without the express written consent of Bistrapay.
XI. Disclaimer of warranties
Bistrapay is provided on an "as is" and "as available" basis. Bistrapay makes no representations or warranties of any kind, express or implied, as to the operation of Bistrapay or the information, content, materials, or products included on Bistrapay. You expressly agree that your use of Bistrapay is at your sole risk.
XII. Dispute Resolution
You agree that any dispute arising out of or related to your use of Bistrapay will be governed by the laws of the country in which the Bistrapay entity is located, without regard to its conflict of laws provisions. You agree to submit to the personal and exclusive jurisdiction of the courts located within the country in which the Bistrapay entity is located.
XIII. Entire agreement
These terms constitute the entire agreement between you and Bistrapay and govern your use of Bistrapay, superseding any prior agreements between you and Bistrapay (including, but not limited to, any prior versions of the terms).
XIV. Third-party rights
These terms do not create any rights for any third party.
XV. Miscellaneous
If any provision of these terms is held to be invalid or unenforceable, such provision shall be struck and the remaining provisions shall be enforced. Headings are for reference purposes only and in no way define, limit, construe or describe the scope or extent of such section. Our failure to act with respect to a breach by you or others does not waive our right to act with respect to subsequent or similar breaches. We do not guarantee we will take action against all breaches of these terms.
